Agreement
This website (the “Site”) is operated by hifi Ventures Ltd. (“hifi”, “we”, “us” or “our”). By accessing or using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site. We may update these Terms from time to time by posting a revised version with a new “Last updated” date. Your continued use of the Site after changes are posted means you accept them.
Use of the Site
The Site is provided for general information about hifi and its activities. You agree not to use the Site for any unlawful purpose, attempt to gain unauthorized access to it or its systems, interfere with its operation, or use automated means to scrape or copy its content without our written permission.
No offer or advice
Nothing on the Site is an offer to sell, or a solicitation of an offer to buy, any securities, interests or investment products, and nothing on the Site should be relied on as investment, financial, legal, tax or other professional advice. Any investment, partnership or other transaction with hifi will be made only through definitive written agreements and, where applicable, in compliance with securities laws. Descriptions of projects, partners and capabilities are for information only and do not create any obligation on hifi.
Forward-looking information
The Site contains forward-looking information, including descriptions of projects under development, power and data centre capacity, pipeline figures, timelines and expected outcomes. This information reflects our current expectations and is based on assumptions that may prove incorrect. Actual results may differ materially due to factors including permitting and approvals, utility interconnection and power availability, financing, market conditions, construction risks and counterparty decisions. Figures are approximate and subject to change without notice. We do not undertake to update forward-looking information except as required by law.
Track record
Track record information may include projects led by hifi team members before hifi’s formation or while at other organizations. Those projects were not necessarily undertaken by hifi, and past results are not indicative of future performance.
Intellectual property
The Site and its content, including text, images, video, graphics, logos, the “hifi” name and related marks, are owned by or licensed to hifi and are protected by copyright, trademark and other laws. You may view and print pages for your personal, non-commercial reference. Any other copying, reproduction, distribution or modification requires our prior written consent. Third-party names and logos shown on the Site belong to their respective owners, and their display does not imply endorsement.
Information you submit
If you send us information through the contact form or by email, you confirm it is accurate and that you have the right to share it. Please do not send confidential or proprietary information unless we have agreed in writing to receive it under a confidentiality agreement. Unless such an agreement is in place, we have no obligation to keep unsolicited submissions confidential. Our handling of personal information is described in our Privacy Policy.
Third-party links
The Site may link to third-party websites, such as LinkedIn. We do not control and are not responsible for their content, policies or practices, and a link does not imply endorsement.
Disclaimer
The Site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, hifi makes no representations or warranties of any kind, express or implied, about the accuracy, completeness, reliability or availability of the Site or its content, and disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent permitted by law, hifi and its directors, officers, employees, partners and agents will not be liable for any direct, indirect, incidental, consequential, special or punitive damages, or any loss of profits, data or opportunity, arising from or related to your access to or use of (or inability to use) the Site or reliance on its content, even if advised of the possibility of such damages.
Indemnity
You agree to indemnify and hold harmless hifi and its directors, officers, employees and agents from any claims, losses or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site.
Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You agree to the exclusive jurisdiction of the courts of British Columbia for any dispute arising from these Terms or the Site.
General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and hifi about use of the Site.
